Terms of Service

Welcome to Apateu. These Terms of Service (“Terms”) govern your use of the Apateu platform — our iOS app for apartment subleasing and our web housing agent for apartment search. PLEASE READ CAREFULLY. By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

1. Acceptance of Terms

By creating an account, downloading, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any updates we post from time to time.

2. Changes to Terms

We may modify these Terms at any time. Revised Terms will be effective upon posting with a new “Effective Date.” Your continued use of the App after the Effective Date constitutes acceptance of the updated Terms.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share your personal data. By using the Platform, you consent to our collection and use of information as described in the Privacy Policy.

4A. AI Features & Content

The Platform includes AI features, including the Apateu housing agent and AI-assisted drafting of sublease agreements.

AI output is a starting point, not advice. Documents and answers generated by our AI are provided for your convenience. They are not legal, financial or housing advice, and Apateu is not a party to any agreement you enter with another user. You are responsible for reviewing any AI-generated document before you sign it, and you should consult a qualified professional where appropriate.

Accuracy. Listing and building information may come from third-party sources and can be incomplete or out of date. We do not warrant that AI output is accurate, complete or current.

Your content and AI training. By posting content or interacting with our AI features, you grant Apateu a non-exclusive, worldwide, royalty-free licence to host, display and process that content in order to operate the Platform, and to use it to train, evaluate and improve Apateu’s AI models and housing agent, as described in our Privacy Policy. You can opt out of AI training as set out in that policy. You retain ownership of your content.

5. User Accounts

• Registration: You agree to provide accurate, current, and complete information when creating an account.
• Credentials: You are responsible for safeguarding your password and account. You agree to notify us immediately of any unauthorized use.
• Account Termination: We may suspend or terminate your account if you violate these Terms or for any other reason, without notice.

6. User Conduct

You agree not to:

• Post or transmit content that is unlawful, defamatory, obscene, fraudulent, or otherwise objectionable.
• Harass, threaten, or harm other users.
• Impersonate any person or entity.
• Interfere with or disrupt the integrity of the App or its data.
• Use the Platform for any illegal purpose or in violation of any local, state, or federal law.

7. Listings & Transactions

• Accuracy: You are solely responsible for the accuracy, legality, and completeness of your listings.
• Transactions: Apateu is a facilitator only. We do not control or guarantee any transaction between users. All sales and subleases are private arrangements between users.
• Disputes: You agree to resolve any disputes directly with the other party. Apateu is not liable for any losses or damages arising from such disputes.

8. Intellectual Property

• Our Rights: All content on the App (text, graphics, logos, images, software) is owned or licensed by Apateu and protected by intellectual property laws.
• Your Rights: You retain ownership of content you post. By posting, you grant Apateu a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content in connection with the App.

9. Disclaimers; No Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” APATEU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APATEU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Apateu and its affiliates from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of your violation of these Terms or your use of the App.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will immediately cease, and all provisions that by their nature should survive will survive (e.g., ownership, disclaimers, indemnity, and limitations of liability).

13. Governing Law

These Terms are governed by the laws of the State of California and the United States, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Apateu regarding your use of the App and supersede any prior agreements.
